耿和，著名人權律師高智晟的妻子。2014年8月，高智晟出獄后，一直軟禁在陝北偏遠村庄的大哥家，后被強制失蹤11個月，生死不明、杳無音訊。耿和在紐約第二屆中國人權律師節發表講演。
中國人權律師節－永不消失的高智晟精神
大家好，感謝主辦單位舉辦的人權律師節活動，更感謝大家多年來對中國人權進步事業以及對高智晟先生本人的關注和支持！
今天是高智晟被強制失蹤十一個月，第330天，至今生死不明、杳無音訊。主辦單位對高智晟的這份嘉獎，有著重要的意義。這是對所有在中共暴政之下、不屈不撓地堅持為社會正義工作的所有志士同仁們的鼓勵和褒獎。同時也是對他們家人的极大安慰！對此，我由衷地再次表示感謝！
2014年8月，高智晟出獄后，就一直被軟禁在陝北偏遠村庄的大哥家，在牙齒几乎被摧殘得所剩無几的情況下，都不被允許去就近的城市醫院治牙看醫生。在被限制自由的情況下，他仍然為人權受迫害者撰寫了許多文章，以及出版了兩本專著。其中為709律師群体寫過多篇文章，如《王全璋律師可能的命運》，《寫在709事件兩周年之際》，《全人類正義力量合力促中國釋放王全璋等709人權勇士》，《黎明前黑暗里的人權困境》，《郭飛雄愿望背后的地獄圖景》，以及《2016年中國人權報告》等等。他的兩本專著是《2017年，起來中國》和《中華聯邦共和國憲法草案和制憲思想》。
每次高智晟被強制失蹤，中共當局習慣性不僅不給家人任何消息，甚至聲稱不知此事正如大家所知，最后人就是在他們手里。中國政府的目的其實就是迫使他噤聲，因為他們懼怕高智晟先生為了社會正義發出的聲音，更懼怕高智晟先生為了將來的民主中國寫下的文字！今天，我在這里大聲疾呼─雖然高智晟被失蹤被噤聲了，這恰恰顯示了中共的虛弱，我相信衹要中國當局繼續維護獨裁專制統治，那么像王炳章、高智晟、張海濤及709律師的勇士們反抗中共暴政的精神將永不消失！
十几年來，高智晟總是不放過任何机會為受迫害人士發聲，并以他的親身經歷講述糟糕的中國人權現狀。他希望越來越多的人能夠認識到建立民主憲政社會的至關重要性，并且呼吁更多的人加入到反抗中共專制、爭取人權的行列中來，這符合每個個体及其子孫后代的福祉。
高智晟曾說，“在一個長期的非公正社會里，政權總是使用暴力手段壓制追求公正的人民，必然會引發愈演愈烈的反抗，這是中國每年發生數以萬計的群体抗暴事件的原因，這也是這种极權制度的規律。每一個具体的抗暴記錄，無論其形式如何，都是人性本能追求人權自由的實証，都是本民族生命生長不息的歷史脈動，而國際正義力量的每個具体的關注和支持，都實在地給著這民族以看得見的希望和信心”。
中國，作為一個大國，最應融入世界民主大潮之中。可遺憾的是，當世界上僅有的四個极權專政國家中，古巴和越南都已經實行人民選舉后，中國這個大國卻還在以暴力和欺騙對待自己的國民，使十几億中國人民仍舊處在沒有人權自由的壓迫之中。殊不知，爭取人權自由是人之本性，生生不息，代代不止。不自由，毋宁死！這便是高智晟們在困境里仍不屈不撓地堅持著的偉大价值所在，這也是國際正義力量堅定地支持中國人民爭取自由民主的偉大价值所在！

在人類文明的進程中，推翻破舊之物以建更美好之物乃必然之事，此之為人類進化之本。如舊有之政府不為人民所立、不為人民所治、不為人民所享，則人民建立屬民之政府，亦為必然之理。今香港特別行政區政府已然不為香港人民所立、所治、所享，故今日我等宣告成立香港臨時政府。
“人人生而平等，上天賦予全人類某些不可剝奪之權，包含生命權，自由權、尊嚴權及追求幸福之權。”此乃我等一直所認同及不可踐踏之真理及原則。人民為了不剝奪及不被剝奪，始建立法律及政府以保障自身及他人之權。政府一切之權力，乃源于人所賦予之權。政府如破壞以上原則，則人民有絕對之權力推翻及建立。
如今香港特別行政區政府受中華人民共和國及中國共產党所控制，對香港人民的訴求視若無睹，不斷剝削人民之權利，不立利民之法，反而進一步剝奪人民之自由。香港特別行政區政府今日繞過立法會制定《禁蒙面法》，企圖繼續壓制人民集會之權，不理會香港絕大多數的人民之意愿。我等認為香港特別行政區政府已然失去人民之認可及授權，故今日我等宣布香港特別行政區政府失去其合法性，行政長官，各司、局長立即失去其職位所賦予之權。
香港臨時政府宣布：
一、 原有香港特別行政區政府各部門歸入香港臨時政府管理。
二、 原有香港特別行政區政府行政長官、各司長、各局長及副局長，各部門首長及副首長馬上离任及懸空職位，直至香港臨時政府委任。
三、 各部門馬上停止自二O一八年起所有由香港特別行政區政府所頒布之新政策，各級人員保留其職位，并維持各部門必要之日常運作，直至另行通知。
四、 香港臨時政府任期為五年或直至以全民提名及普選政府之体制及政府首長（以較短日期為准）。香港臨時政府必需在成立起計一年內籌備選舉，并于三年內完成選舉。
五、 香港臨時政府首長及各部門之臨時委任官員，在其任期結束后，終身不可擔任香港政府及公營机构之任何官職及受薪之決策人員。
六、 《香港法律》各條文暫予以保留，直至香港臨時政府頒布新法律。

Today is the 330th day of Gao Zhisheng's forced disappearance for the eleventh month. The sponsor's award to Gao Zhisheng is of great significance. In August 2014, after Gao Zhisheng was released from prison, he has been under house arrest at his eldest brother's house in a remote village in northern Shaanxi. He was not allowed to go to the nearest city hospital to see a doctor when his teeth were almost destroyed. . While his freedom was restricted, he still wrote many articles for human rights victims and published two monographs. In the process of human civilization, it is inevitable to overthrow the shabby and build something better, which is the foundation of human evolution. If the old government was not established by the people, not ruled by the people, and not enjoyed by the people, then it is inevitable for the people to establish a government that belongs to the people. Today, the government of the Hong Kong Special Administrative Region is no longer established, governed and enjoyed by the people of Hong Kong. Therefore, today we declare the establishment of the Hong Kong Provisional Government.
"All human beings are created equal, and God has endowed all human beings with certain inalienable rights, including the right to life, liberty, dignity and the pursuit of happiness." In order not to be deprived and not to be deprived, the people established laws and governments to protect their rights and those of others. All the power of the government stems from the power bestowed by man. If the government violates the above principles, the people have the absolute power to overthrow and establish.
The government of the Hong Kong Special Administrative Region is now under the control of the People's Republic of China and the Communist Party of China, turning a blind eye to the demands of the people of Hong Kong, and constantly exploiting the rights of the people. The former chief executive, secretaries, directors and deputy directors, heads of departments and deputy directors of the original government of the Hong Kong Special Administrative Region will immediately resign and hold vacant positions until the appointment of the Hong Kong Provisional Government.
3. All departments will immediately stop all new policies promulgated by the Hong Kong Special Administrative Region Government since 2018. Personnel at all levels will retain their positions and maintain the necessary daily operations of each department until further notice.
4. The term of office of the Hong Kong Provisional Government shall be five years or until the system of government by universal nomination and universal suffrage and the head of the government (whichever is shorter). The Hong Kong Provisional Government must prepare for elections within one year of its establishment and complete the elections within three years.
5. The head of the Hong Kong Provisional Government and the temporarily appointed officials of various departments shall not hold any official positions or salaried decision-makers in the Hong Kong government and public institutions for life after their term of office expires.
6. All provisions of the "Hong Kong Laws" are temporarily retained until the Hong Kong Provisional Government promulgates new laws.
7. Dissolve the Legislative Council of Hong Kong, elect a provisional Legislative Council within three months, and re-elect the Legislative Council within one year. The provisional Legislative Council has seventy seats. Among them, there are 12 seats in the Hong Kong Island and Kowloon West constituencies, 10 seats in Kowloon East, and 18 seats in the New Territories West and New Territories East constituencies.
