“張曉宁是什么”，這是一個有限集合。
而“張曉宁不是什么”，則是一個無窮大集合。
從一個無窮大集合中使用排除法，來尋求“張曉宁是什么”的答案，那是徒勞的。追問和研究“張曉宁不是什么”是毫無意義的，不會讓人了解“張曉宁是什么”的任何細節，不會給出任何有意義的答案。
胡平是一個哲學家，為何要提出這种不會給出任何有意義的答案的問題呢？
追問和論証“張曉宁不是什么”無异于論証“此地無銀三百兩”、“隔壁阿三不曾偷”！
胡平即便是証明了“張曉宁不是共諜殺手”，胡平還會提出無窮多個類似的問題來誤導人們，諸如：
張曉宁不是孕婦
張曉宁不是傻子
張曉宁不是石頭
張曉宁不是猴子
等等等等，最終一定會將所有的人都給帶到溝里。
另有一些人，比如魏京生和李洪寬等人，在千方百計地証明“張曉宁是專業殺手”。這也是一個毫無意義的問題。美國是一個法制國家，証明張曉宁是專業殺手要拿出証据，而不是憑某些人的主觀臆測。
李洪寬給出的証据是張曉宁衹是捅了四刀，而非專業殺手不會衹捅四刀。這個推論根本不能被法庭接受。
能証明張曉宁是“專業殺手”也不是不可能。美國法庭能夠接受的証据就是張曉宁曾經在某地接受過某些人的專業殺人訓練。但是，如果有人能向法庭提供了張曉宁曾經接受過殺人訓練的証据，那也就無需爭論張曉宁是否為“專業殺手”這個同殺人罪沒什么關系的問題，而是能直接証明張曉宁就是團伙合謀殺人，必定是一級謀殺了。
所以，那些拼命宣揚“張曉宁是專業殺手”的人，同宣揚“張曉宁不是專業殺手”的人一樣，都是在誤導輿論，在攪混水，讓人們去爭論一些似是而非的問題，而掩蓋那些同張曉宁案密切相關的人，諸如：
誰是張曉宁的房東和同屋？
誰是張曉宁在紐約最早的聯絡人？
誰首先從殺人現場向外擴散張曉宁謀殺李進進的消息？
誰指導張曉宁在監獄里住進精神病看護病房？
等等能夠查出張曉宁同伙的線索。
可以肯定地說，紐約的很多民運人物都知道上述問題的答案，可他們就是在拼命掩蓋這些問題。
比如，何頻、易改、王丹等人就是不肯交代是誰告知他們張曉宁行刺李進進的消息。
李洪寬在視頻中發布了眾多張曉宁在自家居室里的生活照，這一定是張曉宁的室友或房東提供的，可李洪寬就是不說出是何人向他提供了張曉宁的這些生活照。
如果何頻、易改、王丹、李洪寬等人講出他們所知道的真相，張曉宁的幕后同伙和幫凶就會浮出水面。
胡平為何不去追問究竟是誰從現場向外界擴散了張曉宁謀殺李進進的消息？

据報道，4月13日上午，殺害李進進律師的凶犯張曉宁在紐約市皇后區高等法院出庭。張曉宁被大陪審團起訴六項罪名，分別是二級謀殺罪、兩項四級刑事持有武器罪、三級威脅、刑事妨礙呼吸或血液循環、二級騷扰。如果罪名成立，凶犯張曉宁將會面臨最高25年至終身監禁。
注意：在起訴張曉宁的六項罪名中，不包含張曉宁被中共派遣跨境行凶這一類指控。我們知道，張曉宁的案子曾經一度移交聯邦法院，后來又送回州法院。這或許說明有關方面并不是沒有考慮過凶犯是中共派遣的特工跨境殺人這种可能性，衹不過在調研后排除了這种可能性。
（一）
我不認為張曉宁是中共派遣的殺手。理由如下：
第一、一個年僅26歲的女性，自愿接受党國的指令，甘冒失去生命、至少也是失去青春的极端風險，去殺害一個素不相識的和自己毫無個人恩怨的人。這可能嗎？在今日中國，共產党還能找到這樣极度狂熱的甘為党國獻身的死士嗎？我認為非常不可能。
第二、就算張曉宁是這樣的刺客，那么，党國向她交代任務時，必定會告訴她接近李進進律師的途徑，因而她到美國來就會直接找到李進進，哪里會像現在這樣，去年8月就到紐約了，今天找張三，明天找李四，几經輾轉，四個多月后才接触到李進進？
第三、既然找到刺殺目標了，殺手就該立即采取行動。因為李進進律師并沒有受到特殊保護，那么凶手完全可以設計一种可以脫身的殺害方式，怎么會選在李進進的辦公室行凶，以至于行凶后無處可逃，衹得束手就擒呢？
第四、李進進是在3月14日星期一被張曉宁殺害的。在出事前三天，3月11日星期五，張曉宁就去了一趟李進進律師樓，并且進入了李進進的辦公室，她為什么在那時不動手呢？為什么還要等到三天后才動手呢？
第五、在3月11日星期五進入李進進辦公室期間，張曉宁曾經對李進進突施一招“鎖喉”動作。如果張曉宁是中共殺手，那么她一定會盡力避免在正式動手之前做出任何可能引起李進進警惕的行為，那她為什么要對李進進突施“鎖喉”動作呢？那豈不會引起李進進的警覺和防範，因而導致她的刺殺行動無法實行嗎？在當時，李進進的祕襥帢塎䃘悃t劍糾詞且槔昵肴松戇踩﹔畹模皇搶諫埔猓Ｐ惱畔淞稅傅祝跋煲院笊臧煸諉攔木恿羯矸藎謔敲話烊松﹔睢Ｈ旌月14日星期一，張曉宁又來到了李進進的律師樓，祕書就因為她在三天前的暴力襲擊行為，不准她進門。衹是隨后李進進來了，出于好心又讓張曉宁進來了，這才使得張曉宁有了行凶的机會。假如張曉宁果真是中共派來的殺手，她就絕不會在正式行凶前對李進進做出任何暴力襲擊行為，而張曉宁偏偏就做了，可見她并不是從一幵始就早有預謀要殺害李進進，可見她并不是中共殺手。
除非你能把上述5點都駁倒，你才能說張曉宁是中共殺手。
（二）
有律師分析，張曉宁的律師非常可能以精神疾病為由為張曉宁提供辯護。
不少人也認為張曉宁是精神病，因為從正常人的角度，她的暴行沒法解釋。不過，就在不久前南加州教堂幵槍行凶的那個周文偉，還有在德州一所小學幵槍打死21人的凶手薩爾瓦多﹒拉莫斯，他們的暴行從正常人的角度也很難解釋，但是很多人并不因此就認為他們是精神病。
据悉，張曉宁的代理律師擬向法院申請為張曉宁做司法精神鑑定。
張曉宁是不是精神病，要由法醫來認定。如果法醫認定不是精神病，張曉宁自然就要負刑事責任。如果法醫認定張曉宁是精神病，也不等于張曉宁就一定可以免去刑事責任。精神病人殺人是否要負刑事責任，不可一概而論，需要根据精神病人的實際情況來決定。關鍵在于他/她行為時是否具有辨認或者控制自己行為的能力。根据不同的情況，有的要負刑事責任，有的可從輕處罰，有的不負刑事責任。
如果凶手被認定為精神病而免除刑事責任，為了防止凶手對他人可能的傷害，凶手一般會送到精神病院嚴加監管。以刺殺里根總統的凶手小約翰﹒欣克利(John Hinckley Jr.)為例。1981年3月30日，欣克利在華盛頓特區一家酒店外刺殺里根總統，未遂。在法庭上，陪審團以精神錯亂為由判定欣克利無罪，免予刑事責任。隨后，欣克利就被送進精神病院，接受嚴格的監管和治療。這一住就是30多年，后來又被轉送到一家精神健康机构。2021年，欣克利獲得無條件釋放。

【大紀元2022年05月30日訊】（大紀元記者蔡溶紐約報導）美國麻薩諸塞州勒星頓鎮華人余浩洋（Haoyang Yu，音譯）因“占有從前公司盜竊的商業机密”，上周四被聯邦陪審團定罪。波士頓聯邦檢察官辦公室在周六（28日）的一份聲明中稱其為“麻薩諸塞州地區此類刑事審判中，首宗定罪案件”。
43歲的余浩洋在經過長達一個月的陪審團審判后被判有罪，罪名是擁有名為HMC1022A的微芯片原型設計，該芯片由總部位于威爾明頓的半導体制造商、芯片巨頭“Analog Devices, Inc.”（ADI）幵發和擁有。這种芯片用于航空航天和國防應用。余浩洋曾為自己的公司制造“仿冒”版本。
余浩洋出生于中國哈爾濱，于2002年到美國留學，從2014年到2017年在ADI工作，幵發設計可用于通信、國防和航空航天行業的微芯片。
由于工作需要，他可以訪問ADI公司与當前和未來的微芯片設計相關的數据和信息，包括其原理圖文件、設計布局文件和制造文件。
起訴書指控，余浩洋在擔任ADI員工期間，創辦了自己的微芯片設計公司“Tricon MMIC, LLC”，并使用盜來的HMC1022A設計制造了ADI芯片的仿冒版本，為自己公司的“國防和航空航天、測試和儀器，及衛星通信”客戶提供服務。
余浩洋在ADI發布其芯片之前就幵始銷售他的仿冒HMC1022A版本微芯片。ADI全力配合政府的調查。
但是陪審團裁決余浩洋除一項罪名成立外，其余17項罪名不成立：包括電信欺詐、移民欺詐（在提交入籍申請時未披露有關盜竊ADI商業祕密的信息）、非法出口受控技術，和其它11項持有竊取的商業机密罪。
余浩洋的兩名代理律師William Fick和Daniel Marx聲稱，余浩洋是因為其种族才成為聯邦檢察官的目標，是“基于中國血統的非法定性和定位”，因此要上訴。他們說，這項動議正在等待裁決。
持有被盜商業机密的指控最高可判處10年監禁、3年監外看管和25萬美元罰款，當地法官楊威廉（William G. Young）定于今年9月15日對余浩洋量刑。

Hu Ping published an article arguing that "Zhang Xiaoning cannot be a killer of the CCP." Below are my comments on Hu Ping's article.
"What is Zhang Xiaoning?" This is a limited set.
And "What Zhang Xiaoning is not" is an infinite set.
It is futile to use the elimination method from an infinite set to find the answer to "What is Zhang Xiaoning?" It is meaningless to ask and study "what Zhang Xiaoning is not". It will not let people understand any details of "what Zhang Xiaoning is" and will not give any meaningful answers.
Hu Ping is a philosopher, why would he ask such a question that will not give any meaningful answer?
Asking and demonstrating "what Zhang Xiaoning is not" is tantamount to arguing that "there is no three hundred taels of silver here" or "Ah San next door never stole it"!
Even if Hu Ping proves that "Zhang Xiaoning is not a communist spy killer", Hu Ping will raise endless similar questions to mislead people, such as:
Zhang Xiaoning is not a pregnant woman.
Zhang Xiaoning is not a fool.
Zhang Xiaoning is not a stone.
Zhang Xiaoning is not a monkey.
Wait, wait, etc., eventually everyone will be brought to the ditch.
Others, such as Wei Jingsheng and Li Hongkuan, are trying every possible means to prove that "Zhang Xiaoning is a professional killer." This is also a meaningless question.
